Privacy policy

This notice explains how personal data are used for enquiries, direct bookings and stays at WhyNot Apartment.

1. Data controller

2. Data and purposes

We process contact details, booking and stay information, correspondence, and guest identification details required for statutory registration. Data are used to answer enquiries, manage bookings and stays, send service communications, handle payments and meet public-safety, administrative and tax obligations.

3. Legal bases and required information

Enquiries and booking management rely on steps requested before a contract and performance of the accommodation contract (Article 6(1)(b) GDPR). Statutory registrations and administrative or tax duties rely on legal obligations (Article 6(1)(c)). Information necessary for a booking or required by law must be provided; otherwise we may be unable to process the booking or provide the stay. Providing information does not constitute a general consent to marketing.

4. Recipients and service providers

Data may be communicated to competent authorities when required by law and processed by providers necessary to operate the website, booking system and payments, including Smoobu, the Duda website service and Stripe, according to their respective roles. Booking platforms process data under their own notices when you book through them. The contact form uses Google reCAPTCHA; Google’s privacy policy and terms apply to that service. Data are not published as guest lists.

5. Retention

Enquiry data are retained for the time needed to manage and conclude the request. Booking and stay records are retained for the applicable administrative, tax and public-safety obligations, and where necessary for handling claims. The criterion is the relevant purpose and applicable statutory period; retaining booking records does not imply retaining copies of identification documents for the same period.

6. Your rights

Contact info@whynotapartment.it to request access, rectification, erasure, restriction, portability or objection where applicable under Articles 15–22 GDPR. You may lodge a complaint with the Italian data protection authority, Garante per la protezione dei dati personali, at www.garanteprivacy.it.

7. External services

External payment, booking, social and anti-spam services have their own privacy notices. Information about the recipients used for your booking, their roles and any applicable international-transfer safeguards can be requested from the controller. This notice does not replace those services’ notices.
